Lusa - Business News - Portugal: EC refers state to EU justice court over failure to promote renewables

Brussels, April 29, 2026 (Lusa) – The European Commission (EC) referred Portugal to the European Union Court of Justice on Wednesday for failing to transpose rules promoting renewable energy.

According to the European Commission, Portugal, along with Greece and Malta, failed to incorporate Directive 2023/2413 into law. This legislation concerns the acceleration of the energy transition to renewable sources and the development of clean energy across all economic sectors.

The reinforced rules introduce measures to promote the expansion of renewables, such as facilitating energy system integration through electrification and renewable hydrogen. They also adopt safeguards to ensure more sustainable bioenergy production.

In a separate energy-related move, the EU executive sent a reasoned opinion to Lisbon, the second step in an infringement process. The Commission took this action after Portugal failed to adopt new electricity market rules designed to make consumer prices more stable and less dependent on fossil fuel costs.

It said that implementing this legislation is vital to ensure European households and businesses "face energy costs that better reflect the low production costs of renewable energy and that prices are more predictable."

The electricity market reform also strengthens consumer protection by providing greater freedom of choice when signing contracts and offering better safeguards against supply interruptions.

Portugal, Croatia, and Poland now have two months to respond to the Commission.
