Lusa - Business News - Portugal: Constitutional court rejects PM's appeal regarding family firm

Lisbon, Mar. 5, 2026 (Lusa) - The Constitutional Court rejected the prime minister's appeal to prevent Spinumviva's clients from being included in its register of interests, but the decision is not final because an annulment has been requested.

The decision was reported by Público and confirmed by the Constitutional Court to Lusa in a written response that does not specify the decision's date.

The Ratton Palace indicates that the “plenary session of the court has already ruled not to hear the appeal, but the decision is not yet final” due to a “motion to dismiss” that will have to be considered by the Constitutional Court.

The Constitutional Court also clarifies that this case follows the “rule regarding the publication of judgments relating to declarations of income, assets, and interests,” which means that the decision will only be published “on the Constitutional Court's website after it has become final.”

The case dates back to July last year, when it was reported that the prime minister had filed objections to the public consultation of certain details of his income, assets, and interests declarations submitted to the Transparency Authority, the body responsible for managing the register of interests of public office holders.

Among the contested details was the list of Spinumviva's clients, a company founded by Montenegro and currently owned by his children. The Transparency Authority had asked the prime minister to submit this information as part of the checks carried out on the declarations submitted by the head of government.

Disagreeing with the Transparency Authority, Montenegro lodged an appeal with the Constitutional Court to challenge the body's decision regarding the disclosure of some of this data.
