Lusa - Business News - Portugal: Government approves bill for cultural patronage, acquisition fund

Lisbon, March 26, 2024 (Lusa) - Portugal's outgoing government has, in Cabinet, approved a draft bill for cultural patronage, which provides for a new statute and the creation of a fund for the acquisition of cultural goods for national museums and palaces.
The new law, which will go to parliament, also includes the definition of a system for issuing and awarding cultural vouchers.
According to the Cabinet communiqué, the draft bill, approved in Monday's meeting, "creates a new legal framework for funding incentives in the area of culture", which includes "the cultural patronage statute, the system for issuing and awarding cultural vouchers and the Fund for the acquisition of cultural goods for national museums and palaces."
At the press conference at the end of the last Cabinet meeting of the current government, the prime minister, António Costa, said, without giving details, that "a draft bill for patronage in the area of Culture and new instruments for private support for funding" the sector had been approved.
Last week, the outgoing minister of culture, Pedro Adão e Silva, said publicly that he had completed legislation on cultural patronage, after having reorganised the organic structure of the Heritage area, and that he hoped "that the new formation of parliament will take them forward".
Pedro Adão e Silva was speaking last Thursday, 20 March, during the signing of a memorandum between the Portuguese state and the Livraria Lello bookshop foundation, which acquired the painting "Descida da Cruz" by Domingos Sequeira (1768-1837).
"There was a process of listening to a wide range of entities about what needed to change in the incentive system to create a more favourable environment for private participation in culture, which has been completed, and we have also completed the legal diplomas that materialise this transformation," he announced.
"Before the end of my mandate, I will return the diplomas to all the entities that took part in this process, in the hope that Portuguese society will be able to materialise them in the near future," he said.
According to the government, the diplomas provide for "simplifying patronage procedures, making the respective mechanisms more transparent, taking incentives further and innovating mechanisms in line with the best international practices in this area, for example by creating a mechanism that allows the capitalisation of a fund for the acquisition of pieces for national museums and monuments, in order to obtain more financial resources by mobilising private individuals".
In 2021, the government had already approved new rules for cultural patronage, in which private for-profit organisations are now eligible to receive donations.
In other words, by way of example, companies that organise cultural festivals, galleries or publishers can apply for recognition of the cultural interest of their activities and thus become eligible to receive a donation.
Their patrons can also enjoy tax benefits, depending on whether they are an individual or corporate patron and depending on the type of donation, in cash, in kind or by providing human resources, for example.
Last week, at the same ceremony surrounding the painting "Descida da Cruz" by Domingos Sequeira, Pedro Adão e Silva lamented the country's "very significant backwardness" in the area of cultural patronage, calling on private individuals to participate in culture.
"I have met very few patrons in these two years [in office], and this is a symptom that should concern us all. The state and the ministry of culture have some authority to appeal to more private individuals to join in this responsibility and this endeavour," he urged.
