Lusa - Business News - Portugal: Governing Socialists propose new levy on Netflix, HBO, Disney+

Lisbon, Oct. 21, 2020 (Lusa) - Portugal's governing Socialist Party (PS) has tabled an amendment to the Socialist government's own proposed law on the audiovisual sector that would provide for a new fee to be levied on online streaming platforms, in response to demands from some people in the film industry.
The 44/XIV bill, which has caused much controversy in the sector, has been in discussion since Friday in parliament's committee on culture and communication, along with amendments proposed prior to the start of proceedings by the parliamentary groups of the opposition Social Democratic Party (PSD), People's Party (CDS-PP), Left Block (BE) and Communist Party (PCP).
However, since Frida, the PS has tabled a new amendment specifically relating to the operation of "audiovisual on-demand services", that is, from plaforms such as Netflix, HBO and Disney+, under which these operators would in future be subject to "an annual fee corresponding to 1% of the amount of relevant revenues", though without specifying how these revenues will be verified.
According to the proposed amendment, "if it is not possible to establish the value of the relevant income" from these operators, "the annual value of the fee is assumed to be one million euros".
The proceeds from this new fee would go to the Institute of Cinema and Audiovisual (ICA) to finance the writing, production, distribution and exhibition of cinema and television works in Portugal.
A levy of this kind is among the demands being made by some representatives of the sector, as a way to increase the amount of funding available from the ICA, taking into account the recent diversification of cinema and audiovisual consumption, including via streaming platforms.
The 44/XIV bill is to transpose into Portuguese law a European Union directive from 2018 that aims to regulate the supply of audiovisual media services, which includes pay-TV channels, video-sharing platforms and video-on-demand (VOD) services.
It lists several priorities, including the promotion of Portuguese cinema and audiovisual produced by and/or shown via those services and balanced competition between the various types of service.
The bill stipulates that the levying of the current screening fee - proceeds from which goes to the ICA - should be extended to all types of services where there is advertising.
The subscription fee for television services provided by telecommunications companies such as NOS, MEO and Vodafone is to remain in place. This fee, which is calculated on the basis of €2 for each subscription to access television services, currently does not apply to VOD.
VOD providers - even if under the jurisdiction of another EU member state - are to be required to invest (that is they must earmark part of their investment expenditure) in European and in Portuguese-language works.
The new amendment proposed by the governing PS would add a new annual fee, to be levied on VOD providers.
In the same document, the PS parliamentary group also includes a new definition of the type of works that these operators should invest in, specifying that it should be in the production of "independent European cinematographic and audiovisual works, originally in the Portuguese language."
In the specific case of streaming platforms, the PCP had already proposed an amendment requiring investment "in an amount to be defined annually" and "not less than the equivalent of 1% of the revenues" of these same platforms.
The BEL had also previously proposed that streaming platforms should be covered by the same subscription fee as telecoms operators.
