Lusa - Business News - Portugal: No income tax on wages cut by temporary lay-off to €635 - Deloitte

Lisbon, Mar.31,2020 (Lusa)-Portuguese workers who see their gross pay fall to values close to the national minimum wage of €635 because of the simplified temporary lay-off, will no longer be subject to IRS withholding tax, according to simulations by the consultant Deloitte.

The simplified temporary lay-off, a measure approved to support companies in crisis due to the Covid-19 pandemic, results in the suspension of employment contracts or the reduction of working hours, with workers earning two-thirds of the gross normal salary, 70% of which is financed by Social Security and 30% by the employer.

On this amount, the worker deducts 11% to Social Security and is subject to IRS withholding tax, while the company is exempt from the social contribution (of 23.75%).

Workers earning the national minimum wage of €635 gross, will continue to deduct only the 11% to Social Security, remaining with a net remuneration of €565.15, i.e. they maintain the wage even if they are temporarily laid off since this scheme has as its minimum limit the €635.

The difference in these cases will only be for the company since Social Security will support 70% of the gross remuneration as well as the employer's social contributions, i.e. the cost to the company goes from the previous €785.8 (before the temporary lay-off) to €190.5 (with temporary lay-off), a saving of €595.31.

For both single and married workers, without children, there is no withholding tax if they receive less than €659 gross per month, according to the 2020 IRS tables.

If there are dependents, this year's tables show that the IRS exemption is granted to those who earn up to €686 gross.

According to Deloitte simulations, an employee, whether single or married with two children, who receives €800 gross per month, with the pay reduced by two-thirds because of the temporary lay-off, will no longer pay IRS.

This is because in both cases, with the reduction of wages to two thirds, workers will be paid below the exemption limits.

A single person with a gross remuneration of €800, before the temporary lay-off, would deduct €88 to Social Security and €65.6 of IRS, taking home €646.4 net.

With the temporary lay-off, the workers see the gross remuneration fall to €533.3, but as the minimum limit of the support is €635 gross, then he will keep this value and, therefore, does not withhold tax, only discounting €69.85 to Social Security.

In other words, instead of having a net salary of €646.4, they will have a salary of €565.15 after the discount.

In the case of a couple with two children, with the same gross salary of €800, the workers will no longer deduct €28 to the IRS, maintaining 11% for the Social Security, which means that they will see their net salary fall from €684 to €565.15.

Deloitte's simulations also show that the cost to the company in these situations where the gross salary is €800 falls from €990 (salary plus social contribution) to €190.5, a saving of €799.5 for the employer, which in turn will be financed by Social Security.

In the example of a couple with two children whose gross salary of each is €1,200, the withholding tax is reduced from €141.6 (without temporary lay-off) to €28.

In this example, workers who before the temporary lay-off received €926.4 net, will now receive €684 after deductions for Social Security and IRS, which means €242.4 less at the end of the month.

The saving for the company will be €1,245, which will now be financed by Social Security, paying the company €240 to the employee.

For gross salaries of €1,800, a married worker with two children will see their net salary fall from €1,274.4 to €926.4 with the company's adhesion to the temporary lay-off (€348 less), while a single person without children will have a net reduction from €339 to €894.

The IRS withholding tax will increase from €327.6 to €141.6 in the example of the couple with two children. The single person who has joined the temporary lay-off will now deduct €174 of tax, compared to the previous €369.

The company, on the other hand, will save more than €1,800 by joining the simplified temporary lay-off for these workers, at a cost of only €360.

According to the minister of labour, solidarity and social security, Ana Mendes Godinho, on Monday, around 1,400 companies had asked to join the simplified temporary lay-off, a measure that came into force on Friday.
