Lusa - Business News - Angola: Transfer of $500M from BNA without evaluation by international lawyers

Luanda, Dec.12,2019(Lusa) – António Samalia Manuel, involved in the undue transfer of $500 million from the National Bank of Angola (BNA), revealed in court on Thursday that Valter Filipe, then governor of the central bank, did not submit the contracts to international lawyers.
The former director of the BNA's Management and Reserves department, António Samalia Bule Manuel, 44, began on Thursday to be heard in the trial of the so-called ‘500 million’ case, which began on Monday at the Supreme Court of Angola, where he is accused of crimes of fraud, money laundering and embezzlement.
The defendant is the third to be heard, after the defendants Jorge Gaudens Pontes Sebastião, an Angolan businessman, and José Filomeno "Zenu" dos Santos, former president of the Sovereign Fund of Angola.
According to António Samalia Manuel, his involvement in the case began with negotiations to sign one of the contracts entered into by BNA and Mais Financial Services, managed by Jorge Gaudens Pontes Sebastião, and Resource Conversion, represented by Hugo Onderwater.
The defendant said he was on holiday when he was summoned by the co-defendant Valter Filipe to attend a meeting in London to negotiate and sign the asset allocation, in which the BNA would also participate the legal advisor of the then governor, a legal advisor and the deputy director of the legal office of the central bank, who supported the meeting from Lisbon.
Asked by the judge what steps were taken before the contract was signed, António Manuel replied that experience had guided him to contact, before its implementation, the law firm Norton Rose, which advises the Angolan central bank on contracts of this nature.
In this sense, he reported that he contacted the law firm for a meeting, to which they agreed promptly, but at the meeting, Valter Filipe did not submit the contract to the team, because allegedly the investment promoters presented some reservations.
Urged by the judge to clarify what reservations were presented, the defendant said that the prosecutors felt that it was not the appropriate time to approach Norton Rose, alleging the possibility of conflicts of interest and jeopardising the success of the operation.
António Manuel, who had been a BNA official for nine years, stressed that before signing the contract, Valter Filipe wrote to the then-president to inform him of the steps that had been taken and to request permission to sign the contract.
The contract was signed in August 2017, he said, and the directives for the transfer of the $500 million (€448 million), the first tranche of a total of $1,500 million (€1,346 million) of capitalisation of the fund to be created, were given by Valter Filipe.
The defendant said that the then central bank governor could authorise transfers up to that amount, under the terms of the investment and reserve management policy for bonds and other assets in force at the time.
To the question as to whether there were guarantees for the transfer of the $500 million, the defendant replied that technically there were no securities deposited in the BNA account, adding that the promoters only submitted one technical file.
In today's session, Valter Filipe's defence attorney said his constituent is still hospitalised, but he is stable and improving, and could be heard on Monday.
