Lusa - Business News - Angola: Attorney general working to recover €1.9B from businessman




Luanda, April 18, 2024 (Lusa) - The Angolan justice system is "working" with various countries, including Switzerland and Portugal, to recover almost €1.9 billion euros Luso-Angolan businessman Carlos São Vicente, the Attorney General said on Thursday.
Helder Pitta Grós was speaking at a press conference after a plenary meeting of the Superior Council of the Judiciary of the Public Prosecutor's Office and said that the bank accounts of the son-in-law of Agostinho Neto, Angola's first president, are in Switzerland (more than $1 billion, €940 million), Portugal, Singapore, Dubai and Bermuda.
"We have to execute the judgement that was handed down by the Angolan courts. At the moment there are no more appeals, it's a res judicata case," emphasised the prosecutor.
The Portuguese-Angolan businessman, married to Irene Neto, is serving a nine-year sentence for embezzlement, tax fraud and money laundering, having also been ordered to pay compensation of $500 million (€464 million).
"We have been working with the Swiss authorities to make this money available to the Angolan government," said Helder Pitta Grós, indicating that the Angolan authorities have been to Singapore, for example, to try to recover $550 million (€516 million) and €42,000.
In Bermuda, there is a further $200 million (€188 million), in Dubai $18 million (€16.8 million) and in Portugal €20 million, totalling almost $2 billion that should revert to the Angolan state or remain at the disposal of the Angolan state in the countries where they are, Pitta Grós said.
"In the contacts we've had, we haven't been told: 'this money can't be made available to you'. We've talked, we've talked and they've said that the money is ours," he continued, pointing out that clarification has been requested on some issues, namely that the money was obtained through illicit acts.
"Fortunately, we have all this, and we can show where the money came from and how it got there," he said, pointing out that Switzerland itself informed Angola of the existence of São Vicente's bank accounts.
"It won't be easy for any bank to let a billion go suddenly," he noted, stressing that "we also have to take into account the legal system of these countries" since the courts will also have to authorise the money to be handed over to Angola.
"We're waiting for the processes to get underway, and we're monitoring them. There may be some difficulty for the commercial banks to make so much money available from one moment to the next, [but] the important thing is that we have the decision [so] that the money can be made available to our government," said Pitta Grós.
The head of the Attorney General's Office also said that in the case of Carlos São Vicente, the Constitutional Court ruled differently from the "500 million" case, which involves a son of former President José Eduardo dos Santos, in which it considered that some constitutional principles had not been observed, while the questions of unconstitutionality raised by the defence of the Portuguese-Angolan businessman were rejected.
On the other hand, he reiterated that Angola had not been notified of the opinion of a UN working group on the São Vicente case, which pointed to illegalities in the detention of the businessman and owner of the now defunct AAA insurance company, and therefore could not "take this issue into account".
Pitta Grós said that today's meeting served to address issues related to the management and training of magistrates and highlighted the lack of human resources, waiting for "financial availability so that more than 177 new magistrates can take office and begin their duties".
"It's an issue that concerns us," he said, emphasising that these new officials will help "relieve the pressure" on current magistrates.
Pitta Grós also highlighted the Angolan authorities' commitment to training, supported by organisations such as the United Nations anti-corruption agency and the European Union.
